Why a Rent Agreement is Important

A Rent Agreement (or Lease Agreement) is a legally binding contract between a property owner (landlord) and a tenant who wishes to occupy the property for a temporary duration. Having a written rent agreement is highly beneficial for both parties:

  • Legal Protection: Outlines terms clearly to prevent future disputes regarding rent raises, security deposits, or eviction terms.
  • Official Address Proof: A registered rent agreement is accepted as valid proof of address for opening bank accounts, passport applications, gas connections, and vehicle registration.
  • The 11-Month Convention: Under Section 17 of the Registration Act 1908, leases of 12 months or longer must be compulsorily registered with the Sub-Registrar. To avoid high stamp duty fees and tedious registration procedures, standard rental agreements are written for exactly 11 months.

Crucial Rent Agreement Clauses

When drafting your agreement, make sure these critical clauses are included to avoid legal loopholes:

  1. Rent Amount & Due Date: Specify the monthly rent, due date (e.g. 5th of every month), and acceptable payment channels (Bank Transfer, UPI, Cash).
  2. Security Deposit: Outline the advance deposit amount (typically 2 to 6 months of rent) and write the conditions for deduction of arrears/damage and refund details.
  3. Notice Period & Lock-in: Specify the notice period (usually 1 or 2 months) required before vacating. Mention any 'lock-in period' during which neither party can terminate the contract.
  4. Maintenance Charges: Clarify who pays society maintenance, electricity bills, water taxes, and repair costs (minor repairs like bulbs/leaks are paid by the tenant; major structural repairs by the landlord).
  5. Usage Limitations: Prohibit subletting, commercial usage of residential property, structural alterations, or keep constraints on pets if applicable.

Stamp Duty & Registration Rules

The stamp duty on rent agreements varies by state. Agreements should be printed on non-judicial stamp paper of appropriate denomination or executed via E-stamping portals.

State 11-Month Stamp Paper Value Registration Rules
Maharashtra Calculated based on rent & deposit (minimum ₹100/₹500) Compulsory to register leave & license online regardless of duration.
Karnataka ₹100 to ₹200 (depending on rent/deposit value) Optional but highly recommended for 11-month terms.
Delhi / NCR ₹50 or ₹100 stamp paper Not mandatory under 12 months, but stamp duty must be fully paid.
Tamil Nadu 1% of total rent & deposit payable (usually ₹100 minimum) Mandatory to register under Tenancy Act.

Frequently Asked Questions (FAQs)

According to Section 17 of the Registration Act, lease contracts extending to 12 months or longer must be registered. Landlords and tenants use the 11-month term to bypass sub-registrar visits, heavy registration fee scales, and stamp duties.
Yes. An unregistered 11-month lease agreement is admissible as collateral evidence in court to substantiate a landlord-tenant relationship and the agreed rent amount, provided it was printed on appropriate stamp paper.
By default custom, the tenant usually pays for the stamp paper and drafting costs. However, this is negotiable and many landlords agree to divide the total cost equally.
No. The landlord must adhere to the rent amount specified for the 11-month term. Rent increase can only happen as per the escalation terms in the agreement, which commonly stipulate a 5% to 10% rent hike at the end of the 11-month period.
Unlike a traditional lease which transfers tenancy and interest to the tenant, a Leave & License agreement merely licenses the licensee to occupy the premises. Landlords prefer this as it prevents tenants from claiming permanent possession rights, making eviction simpler.
