What is a Legal Notice?
A legal notice is a formal written warning sent by an aggrieved individual or entity to another, detailing the grievances, alleging violations, and declaring the intention to launch judicial actions if the specified demands are not met.
Key use cases where sending a legal notice is common:
- Cheque Bounce Cases: Statutory requirement under Section 138 of the Negotiable Instruments Act. Notice must be sent within 30 days of the bank bounce.
- Tenant Disputes: Notice of eviction or demand for unpaid rents under the Transfer of Property Act.
- Employer-Employee Grievances: Non-payment of salary, wrongful termination, or violation of HR terms.
- Consumer Protection: Informing a vendor of defects or services before moving to consumer court.
- Government Defendants: Mandatory 2-month notice required under Section 80 of the Civil Procedure Code (CPC) before filing a suit against a government body or public officer.

How to Properly Send a Legal Notice
To ensure your notice holds weight in court, it must be drafted and delivered carefully.
Draft and Proofread
Clearly state the facts, dates, contract details, and specific violations. Make sure names and amounts are 100% accurate. Avoid emotional language; state the facts objectively.
Send via Registered Post AD
Always send the hard copy via Speed Post or Registered Post with AD (Acknowledgement Due). This card is returned to you by the postman once signed by the recipient and acts as concrete proof of receipt.
Preserve Receipts
Keep the postal receipt, a duplicate copy of the signed notice, and the returned AD card safely. They are critical documents that your advocate will file in court.
Track Delivery Online
Check the India Post website tracking tool using the consignment number. Take a screenshot/printout of the delivery status for your records.
Decide on Lawyer Involvement
You can send the notice yourself. However, sending it on an advocate's official letterhead carrying their seal increases gravity and is more likely to trigger a prompt response.
